judging from the picture of the girlfriend in the Canoe article, he probably was inebriated....

Kinda sad thing is, he has 3 kids and just separated from his wife of 14 years.

Drug charges dismissed against former Barenaked Ladies singer

The former lead singer of the Barenaked Ladies rock band now has a clean criminal record, despite his felony arrest for cocaine and marijuana possession near Syracuse last year.

All charges were dismissed today against Steven J. Page, 38, of Toronto, who was arrested in Onondaga County last July, his Buffalo-based attorney disclosed.

"I talked to Steven 20 minutes ago, and he's elated," the attorney, Mark J. Mahoney, said Friday afternoon. "This was not a plea bargain, but an outright dismissal of the charges."

A drug conviction could have been a career disaster for Page, who is a Canadian citizen, his attorney said.

"This [dismissal] is very good news for him, because if he had even a misdemeanor drug conviction, it could have caused him to be barred from entering the United States for years," Mahoney said.

Police said Page and two women friends were arrested last July 11 by officers in the Village of Fayetteville. They were charged with felony drug possession after small amounts of marijuana and cocaine were found in the Fayetteville apartment where the two women -- Christine Benedicto and Stephanie Ford -- live.

Officers reported that they made the arrests after spotting a car in the driveway with its door open. Officers said they looked through a window into the apartment, and observed signs of apparent drug activity. They then found cocaine and pot.

In October, a Fayetteville village justice reduced the charges to misdemeanors, and then approved an adjournment in contemplation of dismissal for all three defendants.

At that time, Judge Thomas J. Miller ruled that if the three avoided trouble and passed random drug tests for a six-month period, he would dismiss the charges. The six-month period ended on Thursday.

"We are very appreciative to the judge and to [Onondaga County District Attorney] William J. Fitzpatrick," Mahoney said.

Did Page receive any preferential treatment because he is a celebrity? "Absolutely not," Mahoney said.

"For first-time offenders caught with user amounts of drugs, it is not unusual for an ACD to be granted," Mahoney said. "In Steven's case, you have an individual who came into this case with a clean record and reputation. He also has a long history of doing things to help charities."

With the popular Barenaked Ladies, Page performed at concerts to raise money for children's hospitals in several cities, the American Lung Association, Make-a-Wish Foundation, Amnesty International and many other charities, the attorney said.

Mahoney added that Page's two co-defendants got the same result in the case.

"He didn't get special treatment. He got fair treatment, despite his notoriety," Mahoney said.

Bridget A. Scholl, the assistant district attorney who handled the case, agreed with Mahoney that it was not unusual for a first-time offender to be treated as Page was.

"The conditions set by the court have been met, and the charges were dismissed," Scholl said.

When asked if Page had a drug problem, Mahoney responded: "His supervision and his compliance with the conditions of the court removed any concern about his possible involvement with drugs. He received counseling over the past six months, but he did not go into rehab."

Page joined the Barenaked Ladies in 1988 and achieved worldwide fame in the Toronto-based band. He was still in the band at the time of his arrest, but announced in February of this year that he was leaving to pursue other entertainment projects.

"He's been writing songs, working on a book, and scouting out the possibility of performing in some kind of Broadway show," Mahoney said.

The attorney was asked if he thinks Page will ever rejoin the band. He said he once asked Page if the band might someday do a reunion tour.

"He just laughed," Mahoney said.

"We're forced to bed, but we're free to dream"
