Tarion Warranty........dicks.

My wife and I moved into our home in February.
The home will be 3 years old in Sept.

The front archway is collapsing.....our builder is dead....and Tarion Warranty refuses to cover this, because according to them.....Its not a Major Structural Defect.

I had a gentleman who owns a Masonry company come by with a Engineer and they say it is a Major Structural Defect.

Just wondering if anyone has ever had dealings with Tarion warranty and its appeal process?

I think I may have to take them to court.

I feel your pain. I moved into a new condo on April 1, 2006. At the end of my first 30 days I submitted a deficiencies list. The builder has 6 months to fix everything that Tarion deem a deficiency. At the end of my 6 months, only a handful of the items on my 6 page list were fixed. Tarion said that after a further review the rest of the items are not deficiencies that the builder is responsible for.

So fast forward to my one year date. I can again submit a list to Tarion. I did, and included the items that were not fixed the first time around. This time they agreed that all items on my list are builder issues. The builder promptly responded and said that they would come in the following week and fix them all.

They came in while I was at work and didn't fix anything, but reported that all issues were resolved.

So now I am left to argue with Tarion. Again. How can an organization meant to protect home owners be funded by the builders?

I have had many of my neighbours tell me that the previous owner knew about this major problem.

So maybe small claims court is a possibility.

I located the home number of the bricklayer.....left him a message...he was shocked as hell that I found out who he was, let alone his home number. He is coming out on Monday.

And to top all this off....my wife and I are expecting our first baby on the 28th. Talk about stress on her.

Tarion can fuck off.

I actually offered to double the inspectors wage for the day, IF she sat underneath the collapsing porch. Strangely enough, she didnt want to accept the offer.

That sucks clutchcdn. Best of luck with in dealing with them, I've heard a lot of stories similar to these.

Chris what type of stuff did you have on your list that it filled 6 pages? I moved into a new condo in September and had a few things like a warped window frame, cracked floor tile, and improperly installed closet door on my 30-day form, but they were fixed in a reasonable amount of time. Now that I'm coming up on 8 months the builder has asked me to submit a list of any remaining items so that they can commence repairs before I have to submit the end of year form to Tarion. I haven't really noticed anything glaring, but maybe I'm not looking hard enough.

There were a lot of issues with my place, and it sounds like that is the way it goes with Camrost Felcorp - my builder.

They forgot to install my built-in microwave, kitchen cabinets without doors, the stainless steel breakfast bar was missing, the sliding doors did not slide, there were spots where the drywall was not finished, loose floor boards, cracked outlet cover plates, stains in the carpet, no caulking around sink edges, uneven threshold to balcony, unfinished joint where windows meet wall, etc, etc...

You're a moron, no one said anything about not having compassion for the third world. Why would you even bring that in to this? I'm sure you'd probably be pretty pissed off if things that were in the contract were incorrectly installed or not installed in a new place you just moved in to. It seems like a pretty legitemate complaint to me. If you moved in to a new place and everything was screwed up would you just ignore it because at least its better than the third world? Get real. Get off your high horse and stop acting like an asshole.

He's a kid.

He's never signed mortgage papers, or any contract of any consequence, but he thinks he knows all about it. It's a common phenomenon: youthful arrogance collides at high speed with lack of experience, and the product is an unearned sense of self-righteous superiority.

Well we've been over this one: old man can't find any argument of substance, so falls back upon age discrimination and his own sense of how the world works in order to explain away anything he can't agree with. It's a common phenomenon. As a result, age and 'experience' make possible such a thing as "earned" self-righteous superiority. Dimwit.

High horse? Moron? Really, I signed a...wait, give me a minute to think. To come across as an experienced youth I can only use very specific words, so that Old Man Skippy here will believe me. I signed a 'contract' with my 'builder' Westmount Industries. I moved in last month, and one of the things that was screwed up was the tanning bed they were supposed to install. Seems like a real Grown-Up complaint to me.

Wow that's ridiculous. Hopefully you can get it sorted out one way or another. I guess I've been pretty lucky with my builder, Conservatory Group, so far (knock on wood). They fixed my original deficiencies list fairly quickly, and seem to be proactive about any additional items as the one-year mark approaches. My only complaint about them is that the building still hasn't been registered, though supposedly the city deserves to share in the blame for that.

Home ownership is the biggest investment most people will ever make, so it's obviously important to ensure they are getting what they paid for, and not being taken advantage of by a builder that cuts corners to pad their earnings. Based on what I hear from a lot of people, it seems like Tarion isn't doing a very good job of it.

You're not an adult skippy, you give the same priority to arguing on an internet forum as any pimply-faced teen who has been offended.

Age and experience do not lead to the same ideas or perspectives, which I assume you think are your own. And using age discrimination in no way shows that you are the adult you think you are. It's generally a dangerous thing to assume you know the experiences of a person, much less specific ones, because of their age. I got married 2 weeks ago, yet that experience changed nothing (except that now, I have an extra piece of paper with some signatures).

Frankly, your idea of adulthood is a joke to me. :lol:
